01. Terms of Asset Acquisition
By engaging with TyphonMachinery.com, placing a deposit, or authorizing a purchase order, you agree to be bound by these industrial Terms and Conditions. These policies govern all transactions involving the Terror X2 Max and the wider Typhon utility fleet.
02. Technical Operator Safety
The operation of a 2.5-Ton Mini Excavator is a high-skill task requiring strict adherence to safety protocols. By taking delivery of Typhon equipment, the purchaser assumes all technical liability:
- Competency Certification: The buyer ensures all operators are trained in excavator control patterns (ISO/SAE) and safe digging practices.
- Site Safety: Compliance with local utility "Call Before You Dig" (811) requirements and OSHA trenching standards is mandatory.
- Liability Waiver: Typhon Machinery assumes no liability for injuries, utility strikes, or structural collapses resulting from improper operation.
- PPE Requirements: Proper high-visibility gear, head protection, and hearing safety must be utilized at all times.
03. Data Accuracy & Specifications
We maintain rigorous documentation for engine configurations (Yanmar, Kubota, B&S) and hydraulic data. However, industrial manufacturing is subject to technical evolution:
- Specification Variance: Typhon reserves the right to modify hydraulic flow rates or engine tuning specs to meet evolving EPA/CARB standards.
- Pricing Integrity: We reserve the right to correct clerical errors in pricing or shipping quotes even after order confirmation.
- Tier 4 Final / Stage V: All power plants are verified to meet current emission standards at the time of manufacture.
04. Logistics & Heavy-Haul Freight
Logistics for a Terror X2 Max follow professional construction-grade protocols. Standard courier rules do not apply:
- FOB Shipping Point: Ownership and risk of loss pass to the purchaser once the machine is secured to the carrier's flatbed.
- Unloading Capacity: The buyer must provide professional unloading equipment (ramps, docks, or 5k+ lb forklift) at the delivery site.
- Damage Reporting: Any transit-related mechanical issues must be documented on the Bill of Lading (BOL) before the driver departs.
05. Limitation of Remedies
In no event shall Typhon Machinery be liable for consequential damages, including project delay penalties, lost rental revenue, or specialized labor costs. Our liability is strictly limited to the provision of replacement parts under the verified warranty framework.
